Redundancy Pay Entitlements in Australia
When your position is made redundant in Australia, you may be entitled to a redundancy payment (also called severance pay) under the National Employment Standards (NES). The amount depends on your length of continuous service with your employer. Our redundancy pay calculator estimates your entitlement based on your service period and current base pay rate.
Redundancy pay under the NES ranges from 4 weeks’ pay for 1–2 years of service up to 16 weeks’ pay for 9–10 years of service. After 10 years, the entitlement reduces slightly. Employees with less than 12 months of continuous service are not entitled to NES redundancy pay, though their award or enterprise agreement may provide for it.
NES Redundancy Pay Scale
The standard redundancy pay scale under the Fair Work Act is: 1–2 years (4 weeks), 2–3 years (6 weeks), 3–4 years (7 weeks), 4–5 years (8 weeks), 5–6 years (10 weeks), 6–7 years (11 weeks), 7–8 years (13 weeks), 8–9 years (14 weeks), 9–10 years (16 weeks), and over 10 years (12 weeks). Note the reduction after 10 years, which reflects long service leave entitlements that may apply.
Some modern awards and enterprise agreements provide more generous redundancy provisions. Always check your specific award or agreement, as it may override the NES minimum. Our calculator uses the NES scale by default.
What Else Are You Owed?
In addition to redundancy pay, your employer must pay out any accrued annual leave and long service leave upon termination. You are also entitled to your normal pay up to your last day of work, plus any notice period pay if your employer asks you to leave before the notice period expires.
The minimum notice period under the NES is 1 week for up to 1 year of service, 2 weeks for 1–3 years, 3 weeks for 3–5 years, and 4 weeks for over 5 years. Employees over 45 with at least 2 years of service receive an additional week.
